These terms

These terms apply to every order placed through this website. By placing an order you accept them. The website is operated by Ecosafe Network Limited, trading as Mamstar.

Orders

Placing an order is an offer to buy from us. A contract is formed when we confirm your payment. We may decline an order — for example where a product is unavailable, where an address falls outside the areas we deliver to, or where we are unable to verify the details you have given us.

Prices

All prices are shown in Kenya Shillings and are the prices displayed on the website at the time you place your order. The price shown is the full amount payable for the water — no further taxes or charges are added at checkout. Delivery within Kandisi is free. For addresses outside Kandisi, any charge is shown to you before you pay.

We may change our prices at any time, but a change will never affect an order you have already paid for.

Payment

Payment is made by M-Pesa. Your order is confirmed only once we receive confirmation of payment from Safaricom. If a payment fails, is cancelled, or times out, your order remains unpaid and no delivery or collection will be arranged. You are free to try again.

If money leaves your account but your order does not show as paid, contact us with your order number and your M-Pesa reference and we will reconcile it against our records.

Delivery and collection

We deliver to the areas listed at checkout. Delivery times given on this website are estimates and not guarantees. If we are unable to complete a delivery, we will contact you on the number you provided to arrange another time.

Where you choose collection instead of delivery, your order will be held for you at the collection point you selected. Please bring your order number.

Bulk and tanker orders

Bulk orders are collected by the customer's own tanker from the loading point selected when the order is placed. The loading reference issued on payment must be presented at collection.

The tanker registration recorded on the order must match the vehicle presented at the loading point. If you need to change the vehicle, the date, or the volume, contact us before you travel.

Product quality

We supply packaged drinking water treated at our own facility. If you receive a product that is damaged, leaking, or that you believe is not fit to drink, stop using it and contact us immediately so that we can replace it or refund you.

Our liability

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence.

Subject to that, we are not liable for losses that were not reasonably foreseeable at the time you placed your order, or for losses arising from your failure to follow reasonable instructions relating to the storage or use of our products.

Events outside our control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including interruptions to water supply, power or transport, and failures of payment or communications networks.

Changes to these terms

We may update these terms from time to time. The terms that apply to your order are those published on this website at the time you placed it.

Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction over any dispute arising from them.
